Who Can File a Wrongful Death Claim in Georgia?

Georgia has very specific rules when it comes to who can file a claim. According to the Georgia Code, Title 51, Chapter 5, Section 51-4-1, a spouse, child, or parent may file a wrongful death claim on behalf of a deceased loved one. A child of the deceased may only bring a claim if there is no surviving spouse. Likewise, a parent of the deceased may only file a claim if there is no surviving spouse or child.

In cases where there is no surviving spouse, child, or parent a representative of the deceased’s estate may file a wrongful death claim, recoverable by the deceased’s next of kin. In all cases, the statute of limitations to file a claim is the same, two years. This means you have two years from the date of your loved one’s death to file a claim or you may lose your opportunity to do so.
